地理标志合理使用综合保护格局之构建

Construction of A Comprehensive Protection Pattern for the Rational Use of Geographical Indications

地理标志对实现乡村振兴战略与促进地区经济发展具有重要意义,但近年来却引发诸多争议。本文选取“景德镇陶瓷”为典型研究对象,对地理标志案件的宏观和微观两方面进行司法实证分析。发现当前地理标志司法保护中诸多问题的根源在于地理标志权的公有性与商标权的私权性之间存在矛盾。对此,应当建立以品质为核心的地理标志综合保护格局,突出品质标准,规范地名使用,提高注意义务,引入公益诉讼,聚焦重点领域,从而实现地理标志权利专有与社会共有、权利人与经营者之间的利益平衡,实现法理与常理的统一。

Geographical indications are of great significance to realize the strategy of rural revitalization and promote regional economic development,but they have caused many controversies in recent years.This paper selects“Jingdezhen Ceramics”as a typical research object to conduct a judicial empirical analysis of the macro and micro aspects of GI cases.It is found that the root cause of many problems in the current judicial protection of geographical indications lies in the contradiction between the public nature of geographical indication rights and the private nature of trademark rights.In this regard,a comprehensive protection pattern for geographical indications with quality as the core should be established,highlighting quality standards,standardizing the use of geographical names,raising the duty of care,introducing public interest litigation,and focusing on key areas,so as to achieve a balance between the exclusive and social interests of geographical indication rights and social commonality,and between right holders and operators,and realize the unity of legal theory and common sense.
