摘要
数字经济的发展以及老龄化程度的加深,带来了我国金融市场发展的深刻变化。随着涉老年人金融市场的扩大,导致老年金融投资者权利侵害等新的法律问题出现。在参与金融市场活动时,老年金融投资者因认知、操作和技术等方面的限制,容易遭遇信息获取、金融操作及权利保护的问题,影响到老年群体的财务安全及金融市场的整体稳定。探讨老年金融投资者在数字化金融环境中所面临的挑战,分析背后的成因并提出法律层面的保护措施。面对老年金融投资者认知鸿沟、操作障碍以及金融知识与数字技能的缺乏等问题,我国应当制定针对性法律、优化金融服务模式、创新适老化金融产品与服务确保老年金融投资者的权利得到有效保护,应对老龄化社会背景下金融市场面临的挑战,促进我国金融市场的稳定和可持续发展。
Development of the digital economy and the deepening degree of aging have brought profound changes to the development of China's financial market.With the expansion of the elderly-related financial market,new legal issues such as the infringement of the rights of elderly financial investors have emerged.When participating in financial market activities,elderly financial investors,due to limitations in cognition,operation,and technology,are prone to problems in information acquisition,financial operations,and rights protection,affecting the financial safety of the elderly group and the overall stability of the financial market.This article aims to explore the challenges faced by elderly financial investors in the digital financial environment,analyze the underlying causes,and propose legal protection measures.Facing issues such as the cognitive gap,operational obstacles,and the lack of financial knowledge and digital skills among elderly financial investors,China should formulate targeted laws,optimize financial service models,innovate elderly-friendly financial products and services,and strengthen financial education and improve the financial literacy of the elderly through legislation,to ensure the effective protection of the rights of elderly financial investors,address the challenges faced by the financial market in the context of an aging society,and promote the stability and sustainable development of China's financial market.
