网络犯罪治理国际合作:发展趋势、全球协作与中国方案

International Cooperation in Cybercrime Governance:Development Trends,Global Collaboration and Chinese Approaches

网络犯罪的跨国性和复杂性的特征日趋凸显,业已成为国际社会关注的重点问题。跨国网络犯罪的治理本身就面临诸多司法实践的困境,近年来网络犯罪呈现出新的犯罪形态,给全球化视域下网络犯罪治理的国际合作带来新挑战,且网络犯罪呈现技术智能化、人员精细化、危害全球化的发展趋势,强化网络安全领域的国际合作已成为时代共识。因此,有效协调网络犯罪现有的国际性治理机制,逐步建立起全球性的网络犯罪治理模式已成为现实之需。就中国而言,网络安全事关国家安全,我们应立足中国国情,适时地提出中国方案,充分发挥联合国在全球治理中的统筹协调作用,健全现有的区域性网络犯罪治理国际合作机制,构建全新且具有中国特色的网络空间命运共同体,同时积极打造双多边共治进路,化解司法实践困境,以保障我国网络安全。

Cybercrime is showing increasingly prominent features of becoming transnational and more complex and has become a big concern for the international community.The governance of transnational cybercrime itself faces many dilemmas in judicial practice,and cybercrime has showed new criminal patterns in recent years.These bring new challenges to international cooperation in cybercrime governance from a global perspective.Moreover,cybercrime has shown a trend of applying intelligent technologies,involving fewer people,and causing harms across the globe.It has become a consensus by all to strengthen international cooperation in cybersecurity.Therefore,it has become a practical need to effectively coordinate the existing international governance mechanisms for cybercrime and gradually establish a global model for cybercrime governance.In China,cybersecurity is related to its national security.We should take into account China's national conditions and propose the Chinese approaches in due time.We should give full play to the coordinating role of the United Nations in global governance,improve the existing international cooperation mechanism for regional cybercrime governance and build a brand-new community with a shared future in cyberspace with Chinese characteristics.Meanwhile,we should actively take bilateral and multilateral governance approaches to resolve the dilemmas in judicial practice so as to ensure the cybersecurity in China.
