生成式人工智能的“三经九纬”法治新模式

A New Model of Rule of Law for Generative Artifical Intelligence Focusing on“Three Longitudinal and Nine Latitudinal Aspects”

“三经九纬”法治新模式在生成式人工智能治理中是较“规制论”更为“厚”的概念。现有规制之“薄”需要引入新的法治模式来解决生成式人工智能面临的真问题和新挑战,包括在技术基础、应用、标准、可融合的数据算法、可评估的可信度、可转化的规范、对话商谈和主体间统分结合等方面进行法律的适应性改进。在国家战略—产业孵化—立法规范三个经度中,通过部门规章转换产业端需求并改进技术规范,形成生成式人工智能治理路径上的改进策略,包括探索回应型、转化改进型和促进包容型法治新模式。九纬是指技术基础、应用和标准等国家战略的纬度,数据质量、算法优化和算力设施等产业孵化的纬度,法律目的、原则、规则等立法规范的纬度。

The new rule of law model of“three longitudinal and nine latitudinal aspects”is a richer concept than“regulation theory”in generative artificial intelligence governance.The“thinness”of existing regulations requires the introduction of new rule of law models to solve the real problems and new challenges faced by generative AI,including the improvement of the applicability of laws in the aspects of technical basis,technical application,technical standards,convergentable data algorithms,evaluable credibility,transformable norms,dialogue and negotiation,and the integration between entities.The nine dimensions corresponding to three aspects respectively refer to the dimensions of technical basis,technical application and technical standards,data quality,algorithm optimization and computing facilities,and legal purposes,legal principles and legal rules.In the three aspects of national strategy-industry incubation-legislative norms,through ministerial regulations to transform the needs of the industrial side and improve technical norms,to form an improvement strategy on the path of generative AI governance,including exploring a new mode of response,transformation and improvement,and promoting inclusive rule of law.
