随着新一代信息技术的发展,新型网络犯罪案件时有发生,一定程度上扰乱了我国经济社会秩序,如何有效遏制和打击新型网络犯罪成了全国执法部门的重要议题。由于犯罪手段更新迭代加快,所产生的电子证据往往具有数据量庞大,难以搜集、分析和统计的特点,电子数据审查面临如证据的扣押与封存、电子证据的呈现等方面的难题。利用元宇宙技术对电子证据进行审查,可提升审查效率,确保证据的有效性。基于此,文章重点探讨了元宇宙对电子证据审查的积极作用及应用过程中存在的问题,进而提出应建立相应的内部系统规范和外部社会规范来限制元宇宙审查方式等建议,以确保证据的真实性、合法性及相关性。

With the advancement of the new-generation information technology,new types of cybercrime cases occur frequently,which to some extent disrupts the economic and social order.Thus,how to effectively curb and crack down on cybercrimes has become a key issue for law enforcement departments nationwide.Due to the rapid updating and iteration of criminal means,the generated electronic evidence is often in large volume,which is difficult to collect,analyze and statistically analyze.In this case,electronic data review faces challenges such as the seizure and sealing of evidence,and the presentation of electronic evidence.Fortunately,metaverse technology offers a way out.Based on this,the article focuses on examining the positive role of metaverse in the review of electronic evidence and the issues encountered in the application.In the end,proposals are put forward to establish corresponding internal system norms and external social norms to regulate the review methods of metaverse to ensure the authenticity,legitimacy,and relevance of evidence.
