Research on the Dispute Resolution Measures for the Jurisdiction of Global License Rates for Standard Essential Patents

标准必要专利对一国产业和经济发展有着重要的推动作用,部分国家法院在司法实践中积极裁决全球费率,呈现标准必要专利管辖权扩张趋势。在标准必要专利许可过程中,由一国法院裁判全球许可费率一直是争议的焦点,在2020年8月英国最高法院对“无线星球诉华为”“Conversant诉华为和中兴专利纠纷”案中,英国法院开启了主动裁决全球SEP许可费率的国际先例,引起了美国、中国等国家陆续加入裁决SEP全球许可费率的行列。SEP许可费率管辖权争夺加剧,并可能进一步导致国际私法秩序的失序与混乱。因此,探索设立具有非政府组织特征的国际调解院,通过统一裁决标准必要专利全球许可费率来解决标准必要专利全球许可费率的管辖问题。

Standard essential patents play an important role in promoting the development of a country's industry and economy.In some countries,courts actively rule on global rates in judicial practice,showing a trend of expanding the jurisdiction of standard essential patents.In the process of standard essential patent licensing,the determination of global licensing fees by a single country's court has always been a controversial focus.In August 2020,the UK Supreme Court set an international precedent for actively ruling on global SEP licensing fees in the“Wireless Planet v.Huawei”and“Conversant v.Huawei and ZTE Patent Dispute”cases,which led to countries such as the United States and China joining the ranks of judging SEP global licensing fees.The competition for jurisdiction over SEP licensing fees is intensifying,which may further lead to disorder and chaos in the international private law order.Therefore,exploring the establishment of an international mediation court with non-governmental organization characteristics,and resolving the jurisdictional issue of the standard essential patent global licensing rate by unifying the standard essential patent global licensing rate.
