医疗事故案涉医疗机构的刑事合规研究

摘要 医疗事故频发,事后惩罚的传统刑法治理模式难以从源头遏制犯罪的发生,除了医务人员自身的原因,医疗机构往往难辞其咎。刑事风险潜藏于医疗机构内控管理的医务人员管理、医药管理以及医疗器械管理环节中,合规制度的引入才是消解医疗事故犯罪、缓解医患关系、促进医学高质量发展的源头治理路径。构建医疗机构刑事合规体系,需要树立持续更新、责任切割、全面合规、符合伦理的医疗机构管理活动的基本原则;内部设立合规专职部门,外部任用法律、伦理、管理等方面专业人员担任合规官;明确医疗机构合规管理对象,并建立健全医疗机构合规培训与合规绩效考核机制。 Medical accidents occur frequently,and the traditional criminal law governance mode of post-punish-ment is difficult to curb the occurrence of crimes from the source.In addition to the reasons of the medical staff themselves,medical institutions often bear the blame.Criminal risks are hidden in the management of medical staff,medical management and medical devices under the internal control of medical institutions.The introduction of the compliance system is to eliminate the crime of medical accidents and ease the relationship between doctors and pa-tients.To promote the source governance path of high-quality medical development and build a criminal compliance system for medical institutions,we need to establish the basic principles of continuous renewal,responsibility cut-ting,comprehensive compliance and ethical principles in the management activities of medical institutions;A full-time compliance department shall be set up internally,and professionals in law,ethics and management shall be ap-pointed externally as compliance officers;Clarify the compliance management objects of medical institutions,and es-tablish and improve the compliance training and compliance performance assessment mechanism of medical institu-tions.
