On the Basic Principles of Artificial Intelligence Law

人工智能法的基本原则是人工智能法的重要组成部分。既有关于人工智能法基本原则的方案有三原则说、四原则说、八原则说等,这些方案存在设计体系性不足、话语层次不统一等问题。人工智能法基本原则的设计应以发展负责任的人工智能为主线,这一判断既源于对立法目的的分析,也是有效加速和价值对齐理念的平衡。基于该主线,人工智能法的基本原则又可以进行多个层次的展开。其中,第一层次原则包括支持发展创新原则和计算正义原则,前者主要指向对于人工智能发展的支持以及对于知识产权的保护,而后者又可以分为可信、安全和效益三项原则。

The basic principles of artificial intelligence law are an important component of artificial intelligence law.There are several proposals regarding the basic principles of artificial intelligence law,including the Three Principles,Four Principles,and Eight Principles.However,these proposals suffer from inadequate design systems and inconsistent discourse levels.The design of the basic principles of artificial intelligence law should take the development of responsible artificial intelligence as the mainline,which stems from the analysis of legislative purposes and the balance between effective accelerationism and value alignment.Based on this mainline,the basic principles of artificial intelligence can be further developed at multiple levels.Among them,the first level principles include the principles of supporting development and innovation,and the principles of computational justice.The former mainly points to the support for the development of artificial intelligence and the protection of intellectual property rights,while the latter can be divided into three principles:trustworthiness,security,and efficiency.
