摘要
在5G、云计算、物联网等各种数字技术不断诞生的数字时代下,衍化出了沟通实时化、时间弹性化、空间弹性化的新业态用工模式,而这也为我国的工时制度带来了前所未有的挑战,如特殊工时制的滥用、工作时间难以认定、工作时间与休息时间相互渗透等问题如破竹般不断出现。因此针对数字化时代工时制度面临的种种困境,我们需要重新审视现行制度,厘清工作时间认定标准,优化特殊工时制度的使用范围、增加标准工时制度的灵活性,以适应新业态用工模式,保护劳动者的权益,推动经济的健康发展。
In the digital age with the continuous birth of various digital technologies such as 5G,cloud computing,and the Internet of Things,a new industrial employment model of communication information,time flexibility,and space flexibility has been developed,which has also brought unprecedented challenges to China’s working time system.For example,the abuse of the special working hour system,the difficulty in identifying working hours,and the interpenetration of working hours and rest time continue to emerge like broken bamboo.Therefore,in view of the various difficulties faced by the working time system in the digital age,we need to re-examine the current system,clarify the working time identification standard,optimize the scope of use of the special working hour system,and increase the flexibility of the standard working hour system,so as to adapt to the new employment mode,protect the rights and interests of workers,and promote the healthy development of the economy.
