我国红色资源的法律保护路径研究

Research on the Legal Protection Path of Red Resources in China

红色资源作为革命文化的重要历史见证,在社会主义文化建设中发挥重要的载体作用。但由于分布广泛、保护不力等多种因素,部分红色资源遭到破坏。在全面依法治国的背景下,法律作为治理社会的重要工具之一,逐渐渗透至文化建设领域,但在立法、执法、司法、守法层面并未形成红色资源保护的完整体系。因此,我们深入分析加强红色资源法律保护的必要性和重要性,并从上述四个层面提出保护红色资源的现实路径,建议推进红色资源的概念界定以及红色资源保护法的制定;同时加大红色资源保护的执法力度,明晰部门间权责;并深入贯彻公正司法的基本要求、提升司法机关对红色资源保护问题的重视程度;积极引导公民行使监督权利、促进公民履行保护义务。

As an important historical witness of revolutionary culture,red resources play an important car-rier role in the construction of socialist culture.However,due to various factors such as wide dis-tribution and poor protection,some red resources have been destroyed.In the context of com-prehensive law-based governance,law,as one of the important tools for governing society,has gradually penetrated into the field of cultural construction,but a complete system of red resource protection has not been formed at the level of legislation,law enforcement,justice and law-abiding.Therefore,we deeply analyze the necessity and importance of strengthening the legal protection of red resources,and give a realistic path for legal means to protect red resources from the above four levels,and suggest promoting the definition of the concept of red resources and the formulation of the red resources protection law,and at the same time increase the law enforce-ment of red resources protection,clarify the rights and responsibilities among departments,and thoroughly implement the basic requirements of fair justice,enhance the attention of judicial or-gans to the protection of red resources,and actively guide citizens to exercise their right to super-vise and promote citizens to fulfill their protection obligations.
