摘要
遗嘱监护制度作为民法的重要内容之一,受到人们的广泛关注。我国《民法典》第二十九条规定了遗嘱监护制度,丰富了监护的类型。但是目前我国遗嘱监护制度仍然存在遗嘱指定冲突处理缺乏相应的规则,遗嘱指定的监护人取得报酬权和辞任权的缺失,遗嘱监护监督机制不健全的细节性问题。以问题为导向,制定遗嘱指定冲突处理模式,赋予遗嘱指定的监护人取得报酬权和辞任权,健全遗嘱监护监督机制。使遗嘱监护制度发挥其应有的作用,更好地维护被监护人的合法权益。
The testamentary guardianship system,as one of the important contents of civil law,has been widely concerned by people.Article 29 of China’s Civil Code stipulates the testamentary guardian-ship system,enriching the types of guardianship.But at present,China’s testamentary guardian-ship system still exists in the absence of appropriate rules for the handling of testamentary ap-pointment conflicts,the absence of the right to get remuneration and the right to resign,and the imperfect supervision mechanism of the testamentary guardianship.Taking a problem-oriented approach,we have formulated a model for handling conflicts over testamentary appointments,given testamentary-appointed guardians the right to obtain remuneration and the right to resign,and improved the monitoring mechanism for testamentary guardianship.This will enable the tes-tamentary guardianship system to play its proper role and better safeguard the legitimate rights and interests of the ward.
