政府询价采购是一种常见的政府公开采购方式,主要适用于产品规格、标准统一,价格浮动小且货源充足的产品,其中价格为关键因素。然而,实践中询价采购方式在实质性条款认定方面还存在争议。通过分析财政部政府采购第14号指导性案例,明确“提供原厂售后服务承诺函”不是投标人必须响应的实质性条款,并对询价采购方式可能存在的其他问题展开探讨及提出解决思路,希冀为规范政府采购活动献出自己的绵薄之力。

Government inquiry procurement is a common public procurement method,mainly suitable for products with unified product specifications and standards,small price fluctuations,and sufficient supply,where price is the key factor.However,in practice,there is still controversy over the substantive clause determination of inquiry procurement methods.By analyzing the Guiding Case No.14 of the Ministry of Finance on Government Procurement,it is clarified that“providing origi-nal factory after-sales service commitment letter”is not a substantive clause that bidders must correspond to.Other problems that may exist in the inquiry procurement method are discussed and solutions are proposed,hoping to contribute their modest efforts to standardize government procurement activities.
