在著作权保护领域,ChatGPT数据挖掘的过程中所抓取的数据以及其自主整合编译资料输出的“作品”,都存在知识产权侵权的风险。在数据隐私保护领域,由于ChatGPT对于数据的挖掘和整合输出缺乏相关的监管,便会存在泄露个人信息以及商业秘密的风险。在网络法治领域,ChatGPT有概率生成虚假、误导性或者违法信息,会给网络空间的治理带来法律风险。对此,首先需要健全立法体系,通过针对ChatGPT等人工智能安全法的立法。其次,利用现有的法律规范来解释规制相关的法律风险。最后,建立多主体协同一致有效的监管治理体系。

In the field of copyright protection,there is a risk of intellectual property infringement in the data captured in the process of ChatGPT data mining and the ' works ' output of its self-integrated compilation data.In the field of data privacy protection,due to the lack of relevant supervision of ChatGPT for data mining and integrated output,there is a risk of leaking personal information and trade secrets.In the field of network rule of law,ChatGPT has the probability to generate false,misleading or illegal information,which may bring legal risks to the governance of cyberspace.In this regard,there is need to improve the legislative system and pass legislation on artificial intelligence security laws such as ChatGPT.Secondly,the existing legal norms are used to explain the legal risks related to regulation.Finally,it is a must to establish a multi-agent coordinated and effective regulatory governance system.
