少数民族地区非遗保护的地方立法研究(二)——对富宁坡芽文化保护立法的思考

坡芽文化作为文山州富宁县少数民族地区文化的重要组成部分,体现出边陲壮族群众的传统劳动生活和文化智慧。对坡芽文化进行立法保护,既是非物质文化遗产传承、保护的要求,也是充分发挥其文旅开发价值的需要。在《少数民族地区非遗保护的地方立法研究(一)》的基础上,结合富宁坡芽文化保护的实际情况,具体探讨了以地方立法保护富宁坡芽文化的立法目的梳理、立法模式选择、规范内容确定以及相关的立法技术等问题,旨在为坡芽文化保护的立法提供具有现实性、针对性、可行性的建议。

Poya culture,as an important part of the culture of Funing ethnic minority area in Wenshan,also reflects the traditional labor life and cultural wisdom level of Zhuang people in the border areas of Yunnan.The legislative protection of Poya culture is not only the requirement of intangible cultural heritage inheritance and protection,but also the need to fully exert its cultural tourism development value.This paper continues the content of Local legislative research on intangible cultural heritage protection in minority areas(Ⅰ),combined with the situation of the protection of Funingpoya culture,it probes into the problems of the legislative aim,the choice of legislative mode,the determination of the normative content and the related legislative techniques,aiming at providing realistic,targeted and feasible legislative suggestions.
