我国家庭医生签约服务的法治治理探析

Analysis of the Rule of Law Governance of Family Doctor Contracting Service in China

为有效提升医疗资源的合理分配,满足人民日益增长的对于新型医疗形式的需求,我国逐步探索并实行家庭医生签约服务。在应对突发公共卫生事件的过程中,家庭医生除向居民提供基础医疗、公共卫生以及个性化签约等常态化服务外,还具有防控追踪、应急资源分配、突发事件处置、失能人员护理等重要职能。但目前我国的家庭医生签约服务在实践中仍存在服务签约主体欠明确、签约各方权责未厘清、法治治理体系碎片化等法律问题。未来应该不断推进家庭医生签约服务的法治化、科学化和现代化。从明确签约主体、厘清各方权利义务、推进法律规范体系化等方面探讨优化策略,以期能更好地应对我国基层医疗卫生体系建设的需要,为我国家庭医生签约服务法治治理的推进提供纾困之道。

In order to effectively improve the rational allocation of medical resources and meet the growing demand for new forms of medical care,China has gradually explored and implemented the contracted services of family doctors.In the process of responding to public health emergencies,family doctors not only provide residents with regular services such as basic medical care,public health,and personalized contracting but also play important functions such as prevention and control tracking,allocation of emergency resources,handling of emergencies and care for the disabled.However,in practice,there are still legal issues such as the lack of clarity on the subjects of contracted services,the lack of clarity on the rights and responsibilities of the contracting parties,and the fragmentation of the rule of law and governance system.In the future,it is even more important to continuously promote the rule of law and scientific modernization of family doctor contracting services.From the perspective of functional realisation,the path to optimization is explored from the perspective of clarifying the subjects of contracting,clarifying the rights and obligations of the parties,and promoting the systematization of legal regulations,to better respond to the needs of the construction of China's primary health care system and providing relief for the promotion of the rule of law and governance of family doctor contracting services in China.
