本研究旨在分析国际种子知识产权法保护机制及其对种业公司技术创新策略的影响,通过梳理国际种子知识产权法的法律框架和实践应用,包括植物新品种保护、专利法以及商业秘密在种业中的应用,分析了种业公司在技术创新方面所采取的策略,以及这些策略如何与知识产权保护相结合。本研究进一步探讨了知识产权保护对种业公司技术创新的促进和制约作用,指出在激励创新的同时,也需警惕过度保护可能带来的风险,为完善国际种子知识产权法律体系和促进种业技术创新提出了政策建议。

This study aims to analyze the protection mechanisms of international seed intellectual property law and their impact on the technological innovation strategies of seed companies.By reviewing the legal framework and practical application of international seed intellectual property law,including the protection of new plant varieties,patent law,and the application of trade secrets in the seed industry,it analyzes the strategies adopted by seed companies in technological innovation and how these strategies are integrated with intellectual property protection.The study further explores the promoting and restraining effects of intellectual property protection on the technological innovation of seed companies.It points out that while encouraging innovation,the risks of overprotection should also be cautioned against.Policy recommendations are proposed for improving the international seed intellectual property legal system and promoting technological innovation in the seed industry.
