摘要
在未成年人使用App软件过程中,准确理解与严格遵循监护人知情同意原则对未成年人的个人信息保护至关重要。通过对24款App隐私政策协议中未成年人使用条款下监护人知情同意原则的落实适用情况进行分析,发现其中存在着年龄保护范围不一致且缺少分层设计、监护人非理性决策、知情同意虚设、撤回同意规范不清等问题。基于法益保护界分模糊、监护人“理性假设”尚不明晰、识别提示技术相对落后等原因分析发现,要发挥好监护人知情同意原则在App未成年人个人信息保护中的应有作用,应当针对性地从立法上强化法律规定、司法上区分设计场景、实务上优化技术路径以完善体系构建,从而更好地落实监护人知情同意原则及相应法律条款的具体适用,促进未成年人个人信息合法权益的有效保护。
When the minors use App software,an accurate understanding of the application of the principle of informed consent of guardians is essential for the protection of their personal information.Through the analysis of the application of the terms concerning the minors'using Apps under the principle of informed consent of guardians in 24 App agreements,it is found that there are such problems as inconsistent age protection scope,lack of hierarchical design,irrational decision-making by guardians,false informed consent,unclear withdrawal of consent and the like.Based on the analysis of the causes for legal protection points being fuzzy,guardian“rational hypothesis”being unclear,and identification technology being relatively backward,the authors found that it is imperative to refine the guardian's informed consent mechanism from the aspects of strengthening legal provisions,setting up scenario design,and optimizing technical paths so that the principle guardian informed consent to play a good role in protecting the minors'personal information protection in using Apps.Thereafter,the principle of informed consent of guardians and the specific application of corresponding legal provisions will be better implemented to promote the effective protection of the legitimate rights and interests of minors'personal information.
