尽管中华人民共和国最高人民法院与中华人民共和国自然资源部等部门发布政策文件支持宅基地使用权可以继承,地方上也出台了政策文件,对宅基地使用权继承情形进行了规定。但由于受法律层面的缺失、继承主体身份性限制、无偿性与无期限性阻碍等因素的影响,宅基地使用权是否可以继承一直处于争议的状态。学界亦针对宅基地使用权是否可以继承,进行了研究与探讨。解决宅基地使用权继承面临的困境,可以从完善法律规定、明确继承主体身份及继承规则和完善宅基地使用权制度的角度出发,化解宅基地使用权继承面临的问题,使“三权分置”政策中放活农村宅基地使用权的设想落到实处。

Although the Supreme People's Court of the People's Republic of China.The Ministry of Natural Resources of the People's Republic of China,and other departments have issued policy documents supporting the inheritance of the right to use homesteads,local policy documents have also been issued to regulate this inheritance.However,due to the lack of specific laws,limitation on the identity of the inheritance subject,and the absence of compensation and unlimited obstacles,the question of whether the right to use homesteads can be inherited ramains controversial The academic community has also discussed and studied this issue.To resolve the dilemma surrounding the inheritance of the right to use homesteads,we can resolve the problems from multiple angles,perfecting legal provisions,clarifying the identity and inheritance rules for the inheritance subject,and improving the system of the right to use homesteads.This will help to implement the idea of activating the right to use rural homesteads in the policy of“separation of the three powers”.
