摘要
劳动者因用人单位未办理社保参保手续向用人单位主张待遇损失时,损失赔偿尚无统一标准,使得劳动者权益不能得到公平保护。对地方立法和典型案例进行梳理后发现,各地方现行办法对于工作年限未满15年的劳动者如何赔偿、是否考虑劳动者应缴费用与自身过错、应当按月给付还是计算总额后一次性给付等问题仍存争议。通过对该待遇赔偿法律性质与功能的分析,以全面赔偿、损益相抵、效率为赔偿原则,在此基础上以用人单位全体职工月平均工资为基数,以劳动者实际工作年限为缴费年限,扣除个人账户养老金后参照养老保险计发公式计算月养老金,并根据劳动者结束用工时年龄计算赔偿年限,算出总额后一次性给付,是一种具有可行性和公平性的方案。
There is no uniform standard when workers claim compensation losses from their employers due to their failure to comply with social security insurance procedures,which prevents fair protection of the rights and interests of workers.A review of local legislation and typical cases reveals that there are still controversies regarding how to compensate workers with less than 15 years of work experience,whether to take into account the workers'contributions and their own fault,and whether to pay monthly or in a lump sum after calculating the total amount.Through the analysis of the legal nature and function of the compensation,the principles of comprehensive compensation,benefits rule,and efficiency should be upheld.On this basis,the average monthly salary of all the employees of the employing unit is taken as the base,and the actual working period of the worker is taken as the contribution period,the monthly pension is calculated with reference to the formula for calculating the pension insurance after deducting the pension from the personal account,and the number of years of compensation is calculated according to the employee's retirement age,and the total amount of compensation is calculated and paid in one lump sum.
