统一法律适用是维护国家法治统一和保障公民受到平等对待在司法审判中的基本要求,同案同判是推动统一法律适用标准的司法支点。为了化解法律适用分歧,可以在同案同判的理论视域中,建立统一法律适用的标准体系。在内容标准上,以基本权利要素为“同案”识别的比较要点,有助于实现部门法律适用标准的普遍化。在程序标准上,引入平等参与程序和司法说理程序,能够促进统一法律适用标准的可接受性。在技术标准上,综合运用类比推理和演绎推理两种论证规则,保证法律解释的连贯性与法律适用的正确性。
