论我国生态环境法典内在体系的立法融贯

Legislative Coherence of Ecological Environmental Code Interior System

生态环境法典编纂在解决我国环境法体系化严重不足问题的同时,面临由于环境法调整对象的动态性和复杂性,影响法典稳定性的难题。内在体系的建构和融贯有助于化解这一困境。环境法以环境正义作为最高价值,提炼协调原则、预防原则、风险防范原则、公众参与原则、原因者负担原则形成基本原则体系。内在体系融贯性的实现需探究环境法基本原则之间的意义脉络和证立关系、权衡基本原则静态的价值顺位和动态的协作关系以及具体化环境法基本原则。生态环境法典编纂通过确立基本原则作为法典的监管性内容,分编明确不同的次级原则,确立“生态环境保护义务”作为联系内在体系和外在体系的功能概念,总则设置一般制度作为操作性内容,串起分编内容,从而在立法上实现内在体系的融贯。

While solving the problem of serious lack of systematization of environmental law in China,the compilation of the ecological environmental code is faced with the problem of affecting the stability of the code due to the dynamics and complexity of the adjustment objects of environmental law.The construction and coherence of the interior system can help to resolve this dilemma.Environmental law takes environmental justice as the highest value,and refines the principles of coordination,prevention principle,precautionary principle,the principle of engaging the general public,and the principle of the burden on those responsible for the environment to form a system of basic principles.The coherence of the interior system is reflected in the relationship between the principles of environmental law,the static value ranking and dynamic collaborative relationship,and the concretization of the principles of environmental law.The compilation of the ecological environmental code should establish the basic principles as the regulatory content of the code,clarify the different sub-principles in the sub-parts,establish the "Ecological Environmental Protection Obligations" as the functional concept linking the interior system and the exterior system,and set up the general system as the operational content in the general provisions,so as to achieve the coherence of the Interior system in legislation.
