信息网络犯罪的现代化探索需要对共犯从属性做出新解读。在当下信息网络时代,传统的限制从属性与共犯的从属性原理受到了来自实践的挑战。对于共犯从属性原理,应当做出符合信息网络犯罪特点的解读,要承认存在共犯之法益侵害总和大于正犯之法益侵害总和的情形,更要承认当共犯之手段行为或正犯之手段行为出现新的、独立的侵害时,其不再受到共犯从属性理论的支配。以信息网络作为手段的犯罪具有新的、独立的侵害,该侵害的具体影响因子在于“人数”与“传播”;当手段行为不具有“人数”与“传播”两类具体影响因子时,或者手段行为附属于正犯行为时,则仍应当受到共犯从属性的制约。

Exploring the modernization of information network crime requires a new interpretation of accomplice subordination,and in the current era of information network,the principles of traditional restricted subordination and accomplice subordination have been challenged by practice.We should interpret the principle of accomplice subordination in line with the characteristics of information network crime.We should acknowledge there is a situation where the total amount of legal interests infringed by accomplices is greater than that by perpetrators.We should also acknowledge when accomplices or perpetrators conduct new and independent infringements with their means or actions,the crime is no longer subject to the theory of accomplice subordination.Information network crime commits new and independent infringements,the specific impact factors of which are“number of people”and“dissemination”.When the means or actions do not have the specific impact factors of“number of people”or“dissemination”or the means or actions are subordinate to the actions of perpetrators,the crime should still be subject to accomplice subordination.
