摘要
劳务外包是一种人力资源服务经营活动,兼具劳务派遣和业务外包的法律特征,其正当价值在于为组织降本增效,兼顾灵活用工的实际需求,不应被用作逃避雇主责任的工具。劳务外包与劳务派遣在外观上具有一定的相似性,对二者进行分辨的主要目的在于确定劳动关系的真实归属以及法律适用。应当审视个案中的具体法律关系,以人格从属性为关键因素进行实质判定。
Labor outsourcing is a type of human resources service operation activity that combines the legal characteristics of labor dispatch and business outsourcing.Its legitimate value lies in reducing costs and increasing efficiency for organizations,while also considering the practical needs of flexible employment.It should not be used as a tool to evade employer responsibilities.Labor outsourcing and labor dispatch have certain similarities in appearance,and the main purpose of distinguishing them is to determine the true ownership of the labor relationship and the application of law.It is necessary to examine the specific legal relationships in the case and make substantive judgments based on personality attributes as the key factor.
