中华优秀传统法律文化融入司法裁判的机制研究

Research on the Mechanism of Integrating Chinese Excellent Traditional Legal Culture into Judicial Adjudication

中华优秀传统法律文化是习近平法治思想的重要渊源之一,蕴含的德法兼治、民为邦本、司法公正、和合思想具有丰富的内涵。树立文化自信、依法治国、尊重司法规律的需求决定了中华优秀传统法律文化融入司法裁判的必要性。从裁判文书来看,存在融入范围较窄、说理语言笼统泛化、弱化或代替法律论证、援引不规范等诸多问题。在分析原因的基础上,从坚持基本立场、界定法律文化、识别常见领域、掌握融入方法、借鉴有益机制、发挥案例价值等方面,提出优化对策,以期将中华优秀传统法律文化更好地融入司法裁判,实现创造式转化和创新性发展,助力社会主义法治建设。

The outstanding traditional Chinese legal culture serves as a significant wellspring of Xi Jinping's rule of law ideology,encompassing the fusion of morality and legislation,the people as the bedrock of the nation,judicial impartiality,and harmonious coexistence with profound implications.The necessity of integrating the outstanding traditional Chinese legal culture into judicial adjudication is determined by the need to establish cultural confidence,govern the country according to law,and respect justice.Upon examining judgment documents,several issues arise including limited scope of integration,general reasoning language,weakened or substituted legal arguments,and irregular citations.This paper proposes optimization measures based on analysis of these reasons from adhering to fundamental principles,defining legal culture,identifying common areas,mastering integration methods,learning from beneficial mechanisms,and leveraging case value.These measures aim to better integrate the exceptional traditional Chinese legal culture into judicial adjudication while achieving creative transformation and innovative development in order to contribute towards the construction of a socialist rule of law.
