摘要
人口老龄化是经济、社会发展的必然产物,又会影响社会发展。我国的人口老龄化具有“未富先老”“未备先老”的特点,呈现复杂性。随着老龄化进程的加快,超龄劳动者再就业现象日益普遍。超龄劳动者劳动权益保护具有正当性,在与国内外立法情况进行比较分析后,本研究发现我国仍存在超龄就业者用工性质认定标准单一、硬性退休制度存在缺陷和当前的社保政策脱离我国社会背景的问题,对此,可通过包括明确超龄就业者用工性质认定标准、实行弹性退休和延迟退休制度和保障超龄劳动者的社会保险权利在内的措施进行完善,以保护超龄劳动者的权益。
Population aging is the inevitable outcome of economic and social development,and will have an impact on social development.China’s population aging has the characteristics of“getting old before get-ting rich”and“getting old before getting ready”.With the acceleration of the aging process,the re-employment phenomenon of overage workers is becoming more and more common.The protection of the labor rights of over-age workers is legitimate.Comparing with domestic and foreign legislation,it can be found that there are still problems in China such as single identification standard for the nature of employment of over-age workers,defects in the hard retirement system and separation of the current social security policy from the social background of China.In order to promote the protection of the rights of over-age workers,it can be improved by clarifying the criteria for identifying the nature of employment of over-age workers,imple-menting flexible retirement and delayed retirement systems,and guaranteeing the social insurance rights of over-age workers.
