民间文学艺术作品知识产权保护的困境与出路

The Dilemma and Solution of Intellectual Property Protection in Folk Literature and Art Works

民间文学艺术作品具有自身的基本内涵和主要特征。同时,民间文学艺术作品具有知识产权属性,是一种特殊的知识财富或是无形财产,已经被世界绝大多数国家所接受,因而将民间文学艺术作品进行知识产权保护具有重要意义。针对民间文学艺术作品知识产权保护存在的主要问题,即保护范围尚未达成共识、权利主体身份难以确认、独创性要求有不同意见、保护期限存在较大分歧、产权保护制度有待完善,本文提出了完善民间文学艺术作品知识产权保护的可行路径:一是增强民间文学艺术作品保护意识;二是明确民间文学艺术作品权利归属;三是完善独创性艺术作品标准的认定;四是提供知识产权保护行政救济保障;五是建立健全知识产权法律保护制度。

Folk literature and art works have their own basic connotations and main characteristics.Mean-while,folk literature and art works have intellectual property attributes and are a special type of intel-lectual or intangible property that has been accepted by the vast majority of countries around the world.Therefore,it is of great significance to protect the intellectual property rights of folk literature and art works.In response to the main problems in the protection of intellectual property rights in folk literature and art works,such as the lack of consensus on the scope of protection,difficulty in confirming the identity of the rights subject,different opinions on originality requirements,significant differences in the pro-tection period,and the need to improve the property rights protection system,feasible paths have been pro-posed to improve the protection of intellectual property rights in folk literature and art works.The first is to enhance the awareness of protecting folk literature and art works;The second is to clarify the ownership of rights to folk literature and art works;The third is to improve the recognition of standards for original artistic works;The fourth is to provide administrative remedies for intellectual property protection;The fifth is to establish and improve the legal protection system for intellectual property rights.
