中药传统知识保护机制探析:基于中药专利申请

Discussion on the Protection Mechanism of Traditional Chinese Medicine Knowledge Based on Patent Application of Traditional Chinese Medicine

目的:基于中药专利申请及保护现状分析,探讨中药传统知识保护机制的完善策略,强化中药传统知识的知识产权保护。方法:在incoPat专利数据库中检索中药专利申请、专利法律状态等数据,分析中药专利申请授权率和专利质量,在北大法宝司法案例库中检索中药专利侵权纠纷案件数据,分析中药专利司法案件裁判结果和保护效果。结果:中药专利申请较难满足专利授权要求,存在授权率低和质量不高的问题,中药专利权人维权较难,面临保护案例少、保护效果差的困境。结论:建议从完善中药专利审查制度和创新激励机制、综合运用多种传统知识产权保护方式、构建中药传统知识综合保护体系等方面优化中药传统知识保护机制。

Objective:Based on the analysis of the current situation of patent application and protection of traditional Chinese medicine,to explore the improvement strategies of the protection mechanism of traditional Chinese medicine knowledge,and to strengthen the intellectual property protection of traditional Chinese medicine knowledge.Methods:Data on traditional Chinese medicine patent applications,patent legal status,etc.in the incoPat patent database were retrieved,and the authorization rate and patent quality of traditional Chinese medicine patent applications were analyzed.Data on traditional Chinese medicine patent infringement disputes in the Peking University Treasure Judicial Case Library were retrieved,and the judgment results and protection effects of traditional Chinese medicine patent judicial cases were analyzed.Results:It is difficult for traditional Chinese medicine patent applications to meet patent authorization requirements,and the application authorization rate and quality of traditional Chinese medicine patent are low.Traditional Chinese medicine patent holders have difficulties in safeguarding their rights and face the dilemma of fewer protection cases and poor protection effects.Conclusion:This study suggested optimizing the protection mechanism of traditional Chinese medicine knowledge by improving the patent examination system and innovation incentive mechanism,comprehensively utilizing various traditional intellectual property protection methods,and constructing a comprehensive protection system for traditional Chinese medicine knowledge.
