摘要
版权是推动数字经济高质量发展的重要力量,版权保护为数字经济发展创造良好的市场竞争秩序,数字版权产业是数字经济的重要支撑。在区块链技术的推动下,数字版权保护机制能够摆脱确权、用权、维权等困境。然而,由于国内外对区块链技术应用于数字版权保护并无明确的法律规制,数字作品独创性认定困难、智能合约适用问题、监管力度不足等问题亟待解决。基于此,文章提出了构建多方参与的著作权登记实质性审查制度,明确智能合约的法律性质,科学立法和创新监管模式,强化区块链数字版权应用领域的风险监管等具体规制建议。
Copyright is an important force in driving the high-quality development of the digital economy.Copyright protection provides a good market competition order for digital economy,and the digital copyright industry is a vital part of digital economy.Driven by block-chain technology,digital copyright protection mechanisms can overcome difficulties such as property rights confirmation,usage,and defending rights.However,since there is no legal regulations on the application of blockchain in digital copyright protection both domestically and internationally,difficulties in recognizing the originality of digital works,issues with the application of smart contracts,and insufficient regulatory efforts still need to be addressed.Based on this,the article proposes specific suggestions such as building a multi-party substantive review system for copyright registration,clarifying the legal nature of smart contracts,scientific legislation and developing new regulatory modes,and strengthening risk supervision.
