摘要
债务催收是信用服务行业的重要分支之一。21世纪以来,主要服务于消费信贷不良资产处置的债务催收业迎来了高速发展期。然而,受到传统观念和行业治理滞后的影响,债务催收业在迅猛发展的同时,也出现了催收行为异化、竞争失序、投诉高企等诸多乱象。基于消费信贷领域巨额的不良资产处置需求,以及创新社会治理、推动债务催收业健康发展和保护金融消费者合法权益等方面的迫切需要,我国应借鉴境外成熟经验,从制定专门法律法规、明确监管部门、建立行业自律组织、开展行业培训、完善金融机构监管等方面入手,对债务催收行业进行系统性治理,从而推进我国债务催收业规范化、阳光化发展。
Debt collection is one of the most important branches of the credit service industry.Since the 21st century,the debt collection industry,which mainly serves the disposal of consumer credit non-performing assets,has witnessed a period of rapid development.However,affected by traditional concepts and the lagging governance of the industry,the debt collection industry,while developing rapidly,has also witnessed many chaotic phenomena such as the alienation of collection behavior,disordered competition and high level of complaints.Based on the demand for disposal of huge amount of non-performing assets in the field of consumer credit,as well as the urgent need to innovate social governance,promote the healthy development of the debt collection industry and protect the legitimate rights and interests of financial consumers,we should learn from overseas mature experience,and start with formulating special laws and regulations,clarifying regulatory departments,establishing industry self-regulatory organizations,conducting industry training,and improving the supervision of financial institutions,to carry out a systematic governance of the debt collection industry,thus promoting the standardized and sunny development of China’s debt collection industry.
