Data Privacy Governance in Open Science Environment

[目的/意义]科学构建开放科学环境下的数据隐私治理结构、相关路径与策略,可最大限度地保护个人的正当数据与隐私利益。[研究设计/方法]采用文本分析法,围绕数据隐私治理问题,从治理主体、治理客体及治理活动3要素构建数据隐私治理结构,形成治理路径。[结论/发现]开放科学环境下数据隐私治理是以数据隐私为治理对象,以数据所有者、数据控制者、数据处理者、数据中介者、数据监管者、数据利他组织作为治理主体,通过实施数据隐私安全教育、数据隐私风险评估、数据隐私处理、数据隐私监管、数据隐私责任处罚、个人数据权利保障6类治理活动,形成一条整体螺旋向上的循环治理路径。[创新/价值]科学构建开放科学环境下的数据隐私治理结构与路径,以保护个人隐私权益和推进开放科学发展。

[Purpose/Significance] Focusing on data privacy governance issues,this paper explores the construction of data privacy governance structure,related paths and strategies in an open science environment to maximize the protection of legitimate data and privacy interests of individuals.[Design/Methodology] Based on the text analysis method,the data privacy governance structure is constructed from the three elements of governance subject,governance object and governance activity,and the governance path is formed.[Findings/Conclusion] In governing data privacy under open science environment,data privacy is as the governance object,and data owners,data controllers,data processors,data intermediaries,data regulators,and data altruistic organizations are as the governance subjects.Through the implementation of six types of governance activities of data privacy security education,data privacy risk assessment,data privacy processing,data privacy supervision,data privacy responsibility punishment,personal data rights protection,an overall spiral upward circular governance path has been formed.[Originality/Value] This paper innovatively constructs a data privacy governance structure and path in the open science environment,so as to safeguard individual privacy rights and promote the development of open science.
