刑事一体化视野下少年法治体系的本土化构建

The Localization Construction of the Juvenile Legal Education from the Criminal Integration Perspective

我国少年法治体系已逐渐在实体与程序双重互动、犯罪控制与司法体系及刑事政策与社会治理的交叠视野下实现完善与优化,但仍存在系统发展与复杂交错个体问题难以融合的瓶颈。以刑事一体化视野来梳理少年法治体系的整体架构是实现各个环节彼此联动形成合力应对个体化难题的重要抓手,通过将少年法治体系梳理为犯罪控制与预防、少年犯司法体系、少年犯附随后果三个层次,并且按照刑事一体化思路对三个层次以顺位的形式对各自的个体化难题——罪错未成年人的行为分级干预难题、不起诉程序的适用混乱、前科消灭制度尚待完善等问题进行分析,以寻求更切实有利的由点到面的完善少年法治体系的通路,从而使我国少年法治体系得以在现有的基础上构建更为完善且合理的本土化少年法治模型。

China's the juvenile legal education has been gradually improved under the overlapping vision of entity and procedure,crime control and judicial system,criminal policy and social governance.However,there are still problems in the integration of systematic development and complex interlaced individuals.The overall construction of the juvenile legal education from the perspective of criminal integration is an important means to realize the linkage form a joint force to deal with the individual problems.By sorting out the juvenile legal education into three levels:crime control and prevention,juvenile justice system and juvenile collateral consequences,and according to the idea of criminal integration,analyzing the three levels are in the form of order to solve their individual problems-behavioral grading intervention for juvenile delinquents,confusion in the application of non-prosecution procedures,and the need to improve the system of elimination of criminal records,so as to seek a more comprehensive path of the juvenile rule of law system,so that the juvenile rule of law system in China can be constructed.A more perfect and reasonable localized juvenile rule of law model.
