数字法院建设路径研究

当前,以大数据、云计算、人工智能、区块链等技术为代表的数字科技革命,对人类生产生活方式带来了颠覆性变革,也对人类法治进程产生了历史性影响。让数字改革全方位赋能法院工作,既是顺应时代发展之势,也是借助科技变革之势,推动审判工作现代化的必然举措。数字法院建设是司法领域实现全面数字赋能、全程预警监测、保障适法统一、提升司法质效的一场重塑性变革。上海数字法院在不断探索中已经建立了大数据平台、研发模型平台、自动运行平台“三大平台”和数助办案、数助监督、数助便民、数助治理、数助政务“五大板块”的综合性体系架构。为巩固数字法院建设成果,并持续推进改革深入发展,有必要对当前数字法院运行情况进行深入考察,并提出针对性的迭代升级方向和配套措施建议,以确保数字法院建设质量和效果。

Currently,the digital technological transformation,represented by technologies such as big data,cloud computing,artificial intelligence,and blockchain,has brought about disruptive changes to human's way of production and life,as well as historical impacts on the process of rule of law.Empowering the work of courts with digital reform in all aspects is an indispensable measure to promote the modernization of judicial work through technological innovation which goes with the tide.The construction of digital courts is a transformative reform in the judicial system to achieve comprehensive digital empowerment,whole-process early warning and monitoring,the unified application of law,and the enhanced quality and efficiency of justice.The Shanghai digital courts,through continuous exploration,have established a comprehensive structure consisting of three major platforms:big data,R&D model,and automatic operation,as well as five major sections:data-assisted case handling,supervision,access to justice for the people,governance,and administration of justice.To consolidate the achievements of digital courts construction and continue deepening the reform,it is necessary to conduct an in-depth study of the operation of digital courts to propose a targeted direction for iterative upgrading and supportive measures,so that the quality and efficacy of digital courts construction can be guaranteed.
