智能审判系统的试点与运用是推进我国审判工作现代化发展的一大尝试,其不应仅发挥快速搜索法律规范的功效,也应通过类案整理、学说综述等方式生成责任认定体系,为案件关键性问题的审判提供参考建议。危害珍贵、濒危野生动物罪案件的审判工作往往面临着是否需要判断以及如何判断犯罪嫌疑人是否明确知晓涉案动物是国家重点保护的珍贵、濒危野生动物之难题。智能审判系统应从危害珍贵、濒危野生动物罪案件的现实需求入手,厘清案件关键性问题,即“明知”问题的法律逻辑,并在智能审判系统中设置责任认定体系,进一步优化审判效果。智能审判中危害珍贵、濒危野生动物罪责任认定体系构建的基本准则:应以立法为根基、以案例为内涵、以学说为补充,形成类案法律规范库,根据犯罪构成要件编写责任认定体系;形成类案动物名录库,生成审判重点预警及分析;形成类案学术观点库,生成认定“明知”的实体性审判参考建议;设置重要时节提醒点,在辅助生成法律文书时充分发挥宣传效能。在智能审判系统中构建责任认定体系,有助于真正达到智能审判系统辅助实践审判的目标。

The pilot and application of intelligent trial systems is a major attempt to promote the modernization of China’s trial work.It should not only play the role of quickly searching for legal norms,but also generate a responsibility determina⁃tion system through case sorting,theoretical review,and other methods,providing reference suggestions for the judgment of key issues in cases.The trial of the crime of precious and endangered wildlife is often faced with the problem of whether to judge and how to judge whether the suspect clearly knows that the wildlife involved in the case are precious and endan⁃gered wildlife under national key protection.The intelligent trial system should start from the practical needs of cases of en⁃dangering precious and endangered wildlife,clarify the legal logic of the key issues of the case,namely the“knowing”prob⁃lem,and set up a responsibility determination system in the intelligent trial system to further optimize the trial effect.The ba⁃sic principles for constructing a liability determination system for the crime of endangering precious and endangered wildlife in intelligent trials should be based on legislation,cases as connotations,and theories as supplements,forming a library of legal norms for similar cases,and compiling a liability determination system based on the constituent elements of the crime.Establish a list of similar wildlife cases,generate key warning and analysis for trials.Form a library of academic viewpoints on similar cases and generate substantive trial reference suggestions for identifying“knowingly”.Set important seasonal re⁃minder points to fully utilize promotional effectiveness in assisting in the generation of legal documents.Building a responsi⁃bility determination system in an intelligent trial system helps to better achieve the goal of intelligent trial systems assisting practical trials.
