摘要
当前,中国正在经历一段高速发展阶段,社会结构发生巨大变革。居民的收入水平、医疗和社会保障体系、基础设施等方面都在持续提升和改进。这一进程确实为劳动者带来了利益。然而,经济快速增长同时也引发了市场竞争的激烈化,增加了人们的生活和竞争压力。为了维持家庭生计,许多劳动者不得不频繁加班,这导致自愿加班成为常态,从而使“过劳死”现象日益普遍。为此,应建立“过劳死”的认定标准,完善“双工+48小时条款”,确立“过劳死”的认定程序;同时,应更公正地平衡劳资关系,并在工伤事故发生时,确保受害者获得法律规定的均等救助。
Currently,China is experiencing a period of rapid development,accompanied by significant changes in social structure.Residents'income levels,healthcare and social security systems,infrastructure,etc.,are continuously improving.This process has indeed brought benefits to workers.However,rapid economic growth has also intensified market competition,increasing the pressure of life and competition on people.In order to maintain their livelihoods,many workers have to work overtime frequently,leading to voluntary overtime becoming the norm,and consequently,the phenomenon of"death from overwork"becoming increasingly common.To this end,a standard for recognizing"death from overwork"should be established,the"dual-job+48-hour clause"should be improved,and a formal procedure for the recognition of"death from overwork"should be instituted.At the same time,there should be a more equitable balance in labor relations,and it should be ensured that victims receive the legally mandated equal assistance in the event of a work-related accident.
