合作性行政执法模式新样态研究——以认错认罚从宽制度为视角

摘要 传统的行政执法模式是对抗性的,行政机关基于行政优位权凭借单方意志对行政相对人作出执法决定,由此产生行政相对人与行政机关的激烈冲突与对抗。《治安管理处罚法(草案)》第二十条确立的认错认罚从宽制度,让行政相对人在自愿认错认罚下获得从宽处罚机会;公安机关简化有关程序快速办理,提升了执法效率和节约了执法资源。认错认罚从宽制度是公安机关和行政相对人合作解决行政相对人的治安管理违法责任问题的一种行政执法模式新样态,使公安机关和行政相对人实现共赢。 The traditional administrative law enforcement model is confrontational,where administrative agencies make enforcement decisions against administrative counterparties based on their administrative superiority and unilateral will,resulting in intense conflicts and confrontations between administrative counterparties and administrative agencies.Article 20 of the Draft Law on Public Security Ad min istration Punishments establishes a new system of leniency for those who voluntarily admit their mistakes and accept punishment.Under this system,the public security organs simplify relevant procedures and handle them quickly,improving law enforcement efficiency and saving law enforcement resources.The leniency system for admitting mistakes and punishment is a new mode of administrative law enforcement in which public security organs and administrative counterparts cooperate to solve the problem of illegal responsibility of public security management,so that public security organs and administrative counterparts can achieve win-win situation.
