论流域生态环境案件管辖机制的专门化——以洞庭湖流域为镜鉴

On the Specialization of Jurisdiction Mechanism of Ecological Environmental Cases in Basin:Taking Dongting Lake Basin as an Example

流域生态环境案件管辖机制的专门化是环境司法专门化的核心内容之一。洞庭湖流域生态环境案件管辖机制在级别管辖和地域管辖、集中管辖、管辖范围三个方面存在管辖机构专门化的参差不齐、管辖范围的专门化程度低等困境。流域生态环境案件管辖机制符合流域环境资源的整体性规律,契合流域环境司法专门化的要求,由此可洞见流域生态环境案件管辖机制的专门化进路:不仅需要从级别管辖和地域管辖两个角度改进流域生态环境案件管辖模式,还需要从完善顶层设计、做实环境资源法庭、构建巡回审判体系、引导中级人民法院设立环境资源法庭四个维度优化流域生态环境审判专门机构。

The specialization of the jurisdiction mechanism of ecological environmental cases in basin is one of the core contents of the specialization of environmental justice.The jurisdiction mechanism of ecological environmental cases in Dongting Lake Basin has the difficulties of uneven specialization and low specialization of jurisdiction in three aspects:level and regional jurisdiction,centralized jurisdiction and jurisdiction scope.Based on the fact that the jurisdiction mechanism of ecological environment cases in basin conforms to the overall law of environmental resources in basin and meets the requirements of the specialization of environmental justice in basin,it can provide insight into the specialization approach of the jurisdiction mechanism of ecological environmental cases in basin.It is not only necessary to improve the jurisdiction mode of ecological environmental cases in basin from the perspectives of level jurisdiction and regional jurisdiction,but also necessary to optimize the specialized judicial agencies for ecological environment in basin from four dimensions:perfecting the top-level design,implementing the environmental resources court,constructing the circuit trial system,and guiding the intermediate people s court to set up the environmental resources court.
