人格权禁令的适用程序研究

当前我国民法典独立规定的人格权禁令制度的程序有待进一步探索,在互联网时代不断发展的趋势下,社会网络暴力、网络谣言等侵害发生后有无限放大效应,造成后果不可估量;如何有效遏制防范网络侵害并使其有对应的程序保障成为一个亟待解决的问题。人格权禁令制度的正式建立为人格权提供了新的救济途径,但其也衍生出一系列的程序问题。首先对人格权禁令的基础内涵进行界定;并从人格权禁令自身性质出发从人格权禁令的申请标准界定角度、人格权禁令的审查方式及期限角度、人格权禁令的执行程序角度及救济程序角度提出其适用标准与程序规则选择。

The procedure of China’s current system of personality rights injunctions needs to be further explored,as independently stipulated in the Civil Code.Amidst the ever-evolving trends of the internet era,incidents like social cyber violence and online rumors,once they occur,have an infinitely amplified effect,leading to immeasurable consequences.Thus,how to effectively curb and prevent online infringements while ensuring corresponding procedural safeguards has emerged as an urgent issue to be addressed.The formal establishment of the personality rights injunction system provides a new avenue for relief in personality rights,yet it also gives rise to a series of procedural issues.This paper first defines the basic connotation of personality rights injunction,then it puts forward the selection of its applicable standards and procedural rules from the definition of the application criteria the review method and the time limit,the execution procedure and the relief procedure from the nature of the personality right injunction itself.
