以良法善治推进新时代慈善事业高质量发展——《慈善法》修法历程回顾及展望

Promoting High-Quality Development of Philanthropy in the New Era through Good Governance:A Retrospective Analysis of the Amendments to the Charity Law

认真学习贯彻党的二十届三中全会精神,让公益慈善事业在推进中国式现代化的伟大进程中发挥更大作用,是当前和今后一个时期公益慈善领域的首要政治任务。我国慈善事业高质量发展离不开法治建设的有力保障,回顾《慈善法》修法历程,展望其未来发展趋势,是在慈善领域贯彻落实党的二十届三中全会精神的必然要求。为此,本文从修法背景及意义、修法历程与关键保障、新修改的主要内容及历史进步、贯彻落实新《慈善法》中应继续深化研究的几个关键问题等四个方面,对新修改的慈善法进行了系统研究。

The earnest study and implementation of the spirit of the Third Plenary Session of the 20th CPC Central Committee,along with ensuring that public welfare and charity play a greater role in advancing Chinese modernization,are the primary political tasks in the public welfare and charity sectors for the current and future periods.The high-quality development of China's charity sector cannot be separated from the strong support of legal construction.Reviewing the amendment process of the Charity Law and anticipating its future development trends is a necessary requirement for implementing the spirit of the Session in the charity sector.Therefore,this article systematically studies the newly amended Charity Law from four aspects:the background and significance of the amendment,the amendment process and key safeguards,the main contents and historical progress of the new amendments,and several key issues that should continue to be studied in the implementation of the new Charity Law.
