新文科背景下法学学科交叉融合的实现路径研究

Research on the Realization Path of Interdisciplinary Integration of Law Discipline Under the Background of New Liberal Arts

新中国成立以来,中国法学发展经历了初创时期、振兴时期、繁荣时期,进入到当前发展的新时期,取得了巨大的成就。然而,面对纷繁复杂的国际、国内社会环境及大数据、云计算、人工智能、区块链等数字信息化科技手段对社会生活的渗透,传统法学教育模式面临着新挑战,新文科建设为法学教育改革指明了方向,法学学科应积极、主动与其他学科交叉融合,包括学科内和学科间的相互融合。新文科建设背景下,应转换研究范式,梳理基本概念术语、明确研究对象、积极进行理论建构等,形成“法学+”交叉学科;面对新科技革命的全新挑战,应建立基于数字信息技术的立体“法学+”交叉学科;制定与完善针对学科交叉融合的评价体系,创建立体“法学+”学科融合的新型评价体系。

Since the founding of the People's Republic of China,the development of Chinese law has gone through the initial stage,the revitalization stage,the prosperity stage,and has entered a new period of current development,achieving tremendous achievements.However,facing the complex international and domestic social environment and the penetration of digital information technology such as big data,cloud computing,artificial intelligence,and blockchain into social life,the traditional legal education model is facing new challenges.The construction of new liberal arts points out the direction for the reform of legal education.The law discipline should actively and proactively integrate with other disciplines,including intra-disciplinary and inter-disciplinary integration.Under the background of the construction of new liberal arts,we should transform the research paradigm,sort out basic concepts and terms,clarify research objects,actively carry out theoretical construction,and form an law plus interdiscipline.Facing the new challenges of the new technological revolution,we should establish a comprehensive "law plus" interdiscipline based on digital information technology;formulate and improve the evaluation system for interdisciplinary integration,and create a new and comprehensive evaluation system for the law plus discipline integration.
