摘要
教科书作为学校教学活动的重要基础,教科书法定许可制度为我国教科书的繁荣发展提供了制度支持,但在具体适用过程中仍然存在教科书的范围划定存在争议、“教科书”概念不清、“教科书”认定存在冲突等问题。为准确适用著作权法中教科书法定许可,需要确定著作权法意义上的教科书概念,并正确理解及适用“教科书”相关法律规定。教科书的认定应该从规范教科书的范围、教科书需符合公益性以及课堂教学的相关性、数字教科书的纳入等四方面综合判断。
Textbooks as an important basis for school teaching activities,the statutory license system for textbooks provides institutional support for the prosperity and development of textbooks in our country.However,in the specific application process,there are still unclear concepts such as“textbooks”,different regulations on“textbooks”,and different identification about national education planning issues.In order to accurately apply the statutory license system for textbooks in the Copyright Law,it is necessary to determine the textbook concept in the meaning of the Copyright Law,and to correctly understand and apply the relevant laws and regulations of the“textbook”.It is suggested that textbooks should be recognized from four aspects:the scope of the standard textbooks,the need for the textbooks to comply with public welfare,the relevance of classroom teaching and incorporation of digital textbooks.
