中国式现代化视域下环境行政拘留的适用研究

Research on the Path of Environmental Administrative Detention from the Perspective of Chinese path to modernization

中国式现代化是人与自然和谐共生的现代化,党的二十大报告中特别指出中国共产党领导的中国特色社会主义是要谋求高质量发展,要促进人与自然和谐共生,到本世纪中叶要建成富强民主文明和谐美丽的社会主义现代化强国。在这一目标的引领下,如何切实做到经济发展和资源集约,针对环境违法行为进行有力监管和处罚必不可少,公安机关作为行政拘留的决定和执行机关,应当提升其执法行为的专业化,切实发挥环境行政拘留的制度作用,针对环境领域的违法行为及其违法行为人进行教育矫治,深入推进生态环境领域的执法活动更加规范顺畅。

Chinese path to modernization is a modernization in which man and nature coexist in harmony.In the report of the 2Oth National Congress of the Communist Party of China,it is proposed that socialism with Chinese characteristics led by the CPC is to seek high-quality development,promote the harmonious coexistence of man and nature,and build a modern socialist power that is prosperous,strong,democratic,civilized,harmonious and beautiful by the middle of this century.Under the guidance of this goal,it is es-sential to effectively achieve economic development and resource intensification,and to implement effective supervision and punishment measures for environmental violations.As the decision-making and executing authority of administrative detention,public security organs should enhance the professionalism of their law enforcement actions,effectively play the institutional role of environmental administrative detention,carry out education and publicity for illegal behaviors and their perpetrators in the environmental field,and effec-tively promote law enforcement activities in the ecological environment field.
