从形义角度管窥《说文解字》的刑罚文化

A Brief Study of the Penal Culture in Shuowenjiezi from the Perspective of Form and Meaning of Chinese Characters

采用观察研究法、文献研究法,对《说文解字》中的竹部、辛部、刀部、耳部、金部和木部等部首的刑罚字进行重文字形和意义分析,了解先秦两汉时期刑罚手段的多样化和残酷性,以及当代刑罚体系与上古时期刑罚的继承关系,为新时代法治社会建设提供参考。

By using research methods of observation and literature,this paper analyzes Chinese characters with Zhu(竹)-radical,Xin(辛)-radical,Dao(刀)-radical,Er(耳)-radical,Jin(金)-radical and Mu(木)-radical that have the meaning of the penalty in Shuowenjiezi in terms of their forms and their meanings of Chongwen.Understanding the diversity of the means of punishment and its cruelty in the pre-Qin times and Eastern and Western Han dynasties and the inheritance relationship between the contemporary penalty system and the punishment in the ancient times can provide some reference for the construction of the society based on the rule of law in the new era.
