以污染环境罪为视角,探讨了在风险社会中积极刑法观对环境犯罪治理的积极影响。通过梳理环境犯罪保护法益的不同理论,指出环境犯罪治理应坚持积极刑法观,并在社会现实和犯罪预防的基础上推进环境法和刑法的有效衔接,实现人与自然和谐共生。

From the perspective of crime of environmental pollution,the paper explores the positive influence of the view of positive criminal law on the environmental crime governance in risk society.Based on the review of theories of the legal interests of the environmental crime protection,the paper suggests that the view of positive criminal law be applied in the environmental crime management and the effective alignment between the environmental law and the criminal law be promoted on the basis of the social reality and crime prevention,achieving harmony between human and nature.
