摘要
宜商环境评价体系中新增了“劳动力”作为新的评价指标,对“劳动力”指标的考量离不开我国劳动法律制度的完善和落实。以《劳动法》《劳动合同法》为代表的劳动法律制度并非如一些学者和媒体所宣称的那样只有负面作用。虽然有些法律条文侧重于保护劳动者的合法权益,但整体上我国劳动法是保护劳动者利益同时也保护资方利益的制度,是在综合考量劳资双方利益的基础上对劳动者权益的侧重保护,并非所谓的对劳动者权益的单方面保护。从长远看,劳动法甚至是更多地保护了资方利益的法律,对优化宜商环境、保护生产要素、构建和谐稳定的劳动关系等都有明显的效益。
In the Business Ready environment assessment system,the addition of"labor force"as a new e-valuation criterion highlights the importance of China's labor laws being well-developed and enforced.Contrary to claims by some scholars and media outlets,labor legal systems such as the Labor Contract Law are not solely characterized by negative factors.While the legal provisions emphasize the protection of legitimate rights and interests of workers,in practice,China's labor legal system serves to protect the in-terests of both labor and capital,emphasizing the protection of workers'rights based on a comprehensive consideration of both sides,rather than a unilateral protection of workers'rights as commonly portrayed.Moreover,in the long term,the labor legal system tends to protect the interests of capital to a greater ex-tent.It yields evident benefits in fostering a Business Ready environment,safeguarding production factors,and fostering harmonious and stable labor relations.
