检察公益诉讼专门立法问题研究

RESEARCH ON SPECIAL LEGISLATIVE ISSUES FOR PROSECUTORIAL PUBLIC INTEREST LITIGATION

作为习近平法治思想在公益保护领域的原创性成果,检察公益诉讼在维护公共利益方面彰显出独特的制度效能。实践表明,检察公益诉讼无法完全与传统诉讼兼容,当前的立法模式和立法实践相对于该制度的健康发展亦存在不足之处,开展检察公益诉讼专门立法正当其时。推动检察公益诉讼专门立法工作不仅是落实党中央和全国人大常委会部署、回应人民群众期待、破解实践难题的必然要求,而且是建立在良好基础上的有益尝试。检察公益诉讼专门立法应在把握检察公益诉讼规律以及吸收司法案例经验的基础上,对现行制度加以完善;应根据检察公益诉讼的实际需要来整合现有规范,设计出科学的法律框架,明确制度重点内容,为检察公益诉讼的有序进行提供法律依据。

As an original achievement of Xi Jinping thought on the rule of law in the field of public welfare protection,the prosecutorial public interest litigation system shows its unique institutional efficiency in safeguarding public interests.Years of practical experience shows that prosecutorial public interest litigation cannot be fully compatible with traditional litigation,and the current legislative mode and practice have also hindered the healthy development of the system,so it is the right time to carry out special legislation on prosecutorial public interest litigation.Promoting the special legislation of prosecutorial public interest litigation is not only an inevitable requirement to implement the arrangements of the CPC Central Committee and the NPC,as well as respond to the expectations of the people and solve practical problems,but also a foreseeable consequence because of its solid foundation consisting of rich theoretical achievements,active practical exploration and existing normative system.This special legislation should improve the current system on the basis of grasping the law of prosecutorial public interest litigation and absorbing the experience of judicial cases.According to the actual needs of prosecutorial public interest litigation,the paper integrates the existing norms,designs a scientific legal framework,and clarifies the key contents of the system,so as to provide a systematic legal basis for the orderly conduct of prosecutorial public interest litigation.
