从“当代中日关系法律规范”看东亚海域中的中日关系

摘要 1978年《中日和平友好条约》签订以来,以美国因素的深度干扰为背景,中日关系在东亚海域长期处于“趋冷-回暖”的周期性波动中,先后经历了“搁置外交”“斗而不破”“日本在三海而走险”的复杂发展过程。为有效管控海域危机,以《中日和平友好条约》精神为基础,两国政府根据事实状态适时签订的协定和发布的相关宣言、声明、公报、共识等,构成了“当代中日关系法律规范”。近年来,在全球格局变动与日本对外战略调整的背景下,东亚海域的分区水域——东海、南海步入新的危局。究其实质,该危局是国际关系变动时代美日韩联手打造的“新霸权主义”的集中表现。对此,中国应重申《中日和平友好条约》的“精神内核”,适时完善“当代中日关系法律规范”,为中日关系的向好发展提供助力。 Since the signing of the"Sino-Japanese Peace and Friendship Treaty"in 1978 against the backdrop of deep interference from the U.S.,China-Japan relations in the East Asian seas have long been in a cyclical fluctuation of"cooling-warming",experiencing complex developments such as"diplomatic shelving","fighting without breaking",and"Japan taking reckless moves in the three seas".To effectively manage maritime crises,based on the spirit of the"Sino-Japanese Peace and Friendship Treaty",the agreements timely signed by the two governments according to the factual situation,along with related proclamations,declarations,communiques,consensus,etc.,constitute the"contemporary legal norms of China-Japan relations".In recent years,against the backdrop of global changes and Japan's external strategic adjustments,the sub-regional waters of the East Asian seas-the East China Sea and the South China Sea-have entered a new crisis.Essentially,this crisis is a concentrated manifestation of the"new imperialism"jointly created by the U.S.,Japan,and South Korea in an era of international relations changes.In response,China should reaffirm the"spiritual core"of the"Sino-Japanese Peace and Friendship Treaty",timely improve the"contemporary legal norms on China-Japan relations",and provide assistance for the positive development of China-Japan relations.
