西藏融入成渝经济圈的精神卫生法治面向——基于公共法律服务视角

The rule of law on mental health in Xizang's integration into the Chengdu-Chongqing economic circle--in the perspective of public legal service

成渝地区双城经济圈作为一项国家战略,西藏如何有机融入意义重大。西藏精神卫生事业发展相对薄弱,既应成为融圈入群的应然之维,也应以法治工具助力护航。公共法律服务作为一个法社会学中的政治化、法治化、本土化概念,在现代法治坐标体系中的价值独特重要,其规范意蕴和血缘谱系应首先予以厘清。在理性检视西藏精神卫生法治的公共法律服务面临的三重困境基础上,即地方立法滞后、法治力度不够,关键要素缺乏、体系架构不全,专业人才稀缺、理论研究不足,进一步从三个向度对其融入成渝双城经济圈的规范进路进行拟制,即强化政治共识、推动政策共融,夯实自身基础、强化法治建设,把准体系要素、搭建融合平台,以期快速提升西藏精神卫生法治的公共法律服务水准。以此为样本,亦可为西藏融圈入群发展中更多结构要素的参与和激活,提供可鉴性理论范式和实践进路。

The Way for Xizang's organically integrating into the Chengdu-Chongqing twin city economic circle as a national strategy has fundamental significance.The development of Xizang's mental health career is still relatively weak,which is the essential dimension for integrating into the circle&cluster,and the strong demand for legal escort.Public legal service,as a conception from sociology of law with politics,legalization and localization,has distinctive and important values in the rule of law coordinate system,and therefore,its normative implication and consanguineous lineage should be clarified firstly.On the base of rationally examining the triple dilemmas of public legal service in the rule of law on mental health in Xizang,such as delayed local legislation&weak rule of law,shortage of key elements&incomplete framework,and scarcity of professional talents&lack of theoretical research,the corresponding triple normative accesses integrating into the Chengdu-Chongqing economic circle were worked out,such as strengthening political consensus&promoting policy integration,consolidating self-foundation&strengthening the rule of law,and grasping system essential factors&building a fusion platform.Thus,the public legal service level in the rule of law on Xizang's mental health should get a rapid promotion.Taking this as a sample can also provide a referential theoretical paradigm and practical path for the participation and activation of more structural elements in the development of Xizang's integration into circle&cluster.
