意大利知识产权法典化的立法实践及启示

新一轮科技革命与产业变革正掀起国际产业分工格局的历史性重塑。应产业需求,意大利在2005年正式推出《意大利工业产权法典》,通过专门法典针对性提升知识产权制度治理效能。时逢新型工业化、信息化势能轮番冲击经济社会的原有法制保障,《意大利工业产权法典》适时修正,调整完善规范内容并加深与欧盟指令的协调一致性。意大利知识产权规范体系枝繁叶茂之时其根系也愈发庞杂,呈现为实体规范分植于《意大利民法典》《意大利版权保护法》《意大利工业产权法典》三部位阶、内容相异的法律。由此搭建成的知识产权规范体系颇具特色,但也需进一步关联厘清以明晰内部根系主次。意大利立法实践拓宽了我国知识产权规范考量维度,从名目、效力、法律意旨处为我国知识产权基础性法律建设提供启发意义。

Against the backdrop of increasing global competition and rapid economic development,Italy has launched the Italian Industrial Property Code,a major initiative almost half a century after the enactment of the Civil Code.The introduction of this code marks a new step in the construction of the Italian legal system in the field of intellectual property.Italy has optimized its legal system through the enactment of the Code,enhanced the effectiveness of governance,and provided strong rule of law guarantee for economic and social development.In the era of digital economy,Italy has kept pace with the times and amended the Italian Industrial Property Code.The amended code adjusts the details of industrial property norms,further harmonizes with the EU planning directives,and improves the management system of intellectual property protection.This initiative not only reflects the great importance Italy attaches to intellectual property protection,but also shows its determination to actively participate in global intellectual property governance.Italy’s basic legal construction of intellectual property has distinctive features and has achieved remarkable results.Its experience and practice undoubtedly provide a rich dimension of thinking for our country to optimize the basic legal construction of intellectual property.At the same time,Italy’s exploration on the development direction of intellectual property norms also provides useful reference for China’s intellectual property legislation in the future.
