数据知识产权标准体系构建与创新研究

Research on the Construction of Standards System for Data Intellectual Property

随着数据生产要素在数字经济产业发展中占据的位置越来越重要,国家层面陆续出台了系列政策文件,针对数据产权制度构建作出了工作部署。从2021年下半年开始,国家知识产权局在全国范围内部署了数据知识产权试点,针对数据知识产权制度构建进行理论研究和实践探索。随着各试点工作的逐渐推进,迫切需要建立数据知识产权标准体系,借助标准化手段来规范数据知识产权产生、运用、保护、管理及服务。本文对国内外数据知识产权标准化现状进行了梳理,对数据知识产权标准体系进行了研究,提出了数据知识产权标准体系结构图,并对标准体系各个子体系涵盖内容进行梳理,以期为数据知识产权制度构建和完善发挥积极作用。

As the production factor of data takes an increasingly important position in the industrial development of digital economy,a series of policy documents have been issued at the national level,and deployments have been made for the construction of data property right system.Starting from the second half of 2021,China National Intellectual Property Administration has deployed data intellectual property pilots nationwide to conduct theoretical research and practical exploration for the construction of data intellectual property system.With gradual progress of the pilots,it is urgent to establish a standards system of data intellectual property,and regulate the creation,application,protection,management,and service of data intellectual property by means of standardization.This paper sorts out the current situation of standardization of data intellectual property at home and abroad,studies the standards system for data intellectual property,puts forward the structure of standards system for data intellectual property,and sorts out the contents of each sub-system of the standards system,hoping to play a positive role in the construction and improvement of data intellectual property system.
