摘要
算法作为网络空间的一项重要基础性技术,算法治理在网络社会治理中居于关键地位且具有重要意义。基于算法治理的复杂性和特殊性,我们应在实证分析算法技术发展现状、风险、治理困境及其成因,充分考量行业发展、公共利益、法律秩序、数字权利保护等法益平衡基础上,形成算法技术治理与法律治理的思维方法与行动逻辑,从专业化治理之维、场景化治理之维、体系化治理之维探索算法技术法律规制的优化路径,进而构建更加公平透明可解释的算法规范,形成更趋于数字正义共识的技术伦理规则,塑造机制更加健全完善的算法治理体系。
As an important foundational technology in cyberspace,algorithm governance plays a crucial role and holds significant importance in network social governance.Based on the complexity and specificity of algorithmic governance,we should empirically analyze the current status,risks,governance dilemmas,and their causes of algorithmic technology development,fully consider the balance of legal interests such as industry development,public interests,legal order,and digital rights protection,and form a thinking method and action logic for algorithmic technology governance and legal governance.We should explore the optimization path of algorithmic technology legal regulation from the dimensions of professional governance,scenario based governance,and systematic governance,and then construct more fair,transparent,and interpretable algorithmic norms,form more digital justice oriented ethical rules,and shape a more sound and perfect algorithmic governance system.
